May I use a barbecue table on my balcony?

In principle, it is always necessary to clarify the regulations in the respective country. In Austria and Germany, barbecuing on the terrace, balcony or in the garden (or courtyard) is permitted by law. This applies to rented flats, condominiums and owner-occupied homes. However, there are some restrictions: According to the General Civil Code, indirect effects on neighbouring properties such as smoke, odour and noise are prohibited if the usual values are exceeded. For this to be the case, however, the customary use of the property must have been severely impaired - for example, by extreme smoke development. In this case, neighbours can take action against polluters by means of prohibitions.
